1. Introduction

These Terms and Conditions ("Terms") apply to your use of any product, service, or website operated by Finoco AI Private Limited ("Finoco", "we", "us"). By using our services, you agree to these Terms in full. These Terms should be read alongside our Privacy Policy and End User Agreement.

2. Accounts and Access

To access certain features of the Service, you must create an account. You agree to provide accurate, complete information during registration and to keep your credentials secure. You are responsible for all activity that occurs under your account.

You must notify Finoco immediately at hello@finoco.ai if you suspect any unauthorized access to your account.

3. Service Description

Finoco provides an AI-powered portfolio intelligence platform designed for private credit and alternative asset fund managers. The Service includes portfolio monitoring, document analysis, covenant tracking, scenario modeling, news intelligence, and AI-assisted analysis tools.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

4. Fees and Payment

Access to the Service is subject to the pricing agreed in your subscription or commercial agreement with Finoco. All fees are exclusive of applicable taxes. Fees are non-refundable except as expressly stated in your subscription agreement.

Finoco reserves the right to change pricing with 30 days' written notice to existing subscribers.

5. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. Prohibited activities include, but are not limited to:

  • Uploading false, misleading, or fraudulent data
  • Using the Service to engage in market manipulation or insider trading
  • Attempting to access another user's account or data
  • Using automated tools to scrape or extract data from the Service at scale
  • Circumventing any security or access controls

6. Confidentiality

Both parties agree to keep confidential any non-public information disclosed by the other party in connection with the Service. This obligation does not apply to information that is publicly available, independently developed, or required to be disclosed by law.

7. Intellectual Property

All intellectual property in the Service, including software, models, interfaces, documentation, and branding, is owned by Finoco. You are granted only the limited license described in the End User Agreement.

Any feedback or suggestions you provide regarding the Service may be used by Finoco without restriction or compensation.

8. Liability

The Service is not a substitute for professional financial, legal, or investment advice. Outputs from the Service are for informational purposes only. Finoco is not liable for any decisions made on the basis of information provided by the Service.

Our total liability to you shall not exceed the amount paid by you in the three months preceding any claim.

9. Changes to Terms

Finoco may revise these Terms from time to time. We will notify you of material changes by email or by displaying a notice on the Service. Your continued use of the Service after any changes constitutes acceptance of the revised Terms.

10. Governing Law

These Terms are governed by the laws of India. Disputes shall be subject to the exclusive jurisdiction of the courts of Mumbai, Maharashtra. For questions, contact hello@finoco.ai.
